District Attorney Hoovler: Man Sentenced to 22 Years in Prison in

 connection with City of Newburgh Daytime Shootout 

 

Defendant Convicted After Trial of Attempted Murder and related crimes

 

Orange County District Attorney David M. Hoovler announced that on Friday, September 16, 2022, Lavelle Stackhouse, 25, of Newburgh, was sentenced in Orange County Court to twenty-two years in state prison in connection with a shooting of a man in the middle of the day on William Street, in the City of Newburgh, on September 8, 2021. 

On June 22, 2022, Stackhouse was convicted after a bench trial in the Orange County Court of all charges against him including Attempted Murder in the Second Degree. Stackhouse was charged with and convicted of Attempted Murder in the Second Degree, Criminal Possession of a Weapon in the Second Degree, Assault in the Second Degree, Criminal Possession of a Weapon in the Third Degree, and Reckless Endangerment in the First Degree. 

The man that Stackhouse was convicted of shooting at, Joshua Hendrick, 22, of Newburgh, pled guilty on March 2, 2022, in Orange County Court to Criminal Possession of a Weapon in the Second Degree for his role in the shootout. As proven at trial, Stackhouse approached Hendrick on the street, pulled out a firearm and fired at Hendrick, striking Hendrick in the torso and leg. Hendrick pulled out a firearm and returned fire at Stackhouse as Stackhouse ran down the street. Another individual was shot in the shoulder during this incident. The entire shooting was captured on video.

Stackhouse fled the scene and was not located and apprehended until today with the assistance of the United States Marshall Fugitive Taskforce. The City of Newburgh Police Department were assisted in the investigation by Orange County Sheriff’s Office, New York State Police, the FBI Safe Streets Taskforce, United States Marshall Fugitive Taskforce, and the Orange County District Attorney’s Office. 

Stackhouse was sentenced to twenty-two years in state prison, and five years post-release supervision, on the charge of Attempted Murder in the Second Degree; five to fifteen years in state prison, and five years post-release supervision, for Criminal Possession of a Weapon in the Second Degree; three and one-half to seven years in state prison, for Criminal Possession of a Weapon in the Third Degree; seven years in state prison, and five years post-release supervision, for Assault in the Second Degree; and, three an one-half to seven years in state prison for Reckless Endangerment in the First Degree. All the sentences were ordered to run concurrently with each other. 

District Attorney Hoovler thanked all the state, local and federal law enforcement officials, who aided in the investigation and eventual apprehension of Stackhouse and the investigation of Hendrick. 

“I hope that the sentence of more than two decades that was imposed on this defendant today serves to deter others tempted to engage in gunplay on our streets,” said District Attorney David. M. Hoovler. “Offenders in these types of cases need to be identified, charged, convicted, and sentenced to long prison terms to make ensure that our community is safe for us all. My Office will continue work with our law enforcement partners to pursue justifiably lengthy sentences on cases involving gun violence.”   

District Attorney Hoovler highly commended Senior Assistant District Attorney Christopher Kelly and Assistant District Attorney Matthew Bennett who prosecuted the case.
