District Attorney Hoovler: 20 Year Sentence in City of Port Jervis Drug Dealing Case
Defendant Convicted After Jury Trial of Multiple Counts Including Criminal Sale of a Controlled Substance in the Third Degree
Orange County District Attorney David M. Hoovler announced that on Tuesday, November 1, 2022, Jarves Evans, a/k/a “J”, 26, of Newburgh, was sentenced to a total of twenty (20) years in state prison and three years post-release supervision following his conviction after a jury trial in Orange County Court of two counts of Criminal Sale of a Controlled Substance in the Third Degree, Criminal Possession of a Controlled Substance in the Third Degree and Criminally Using Drug Paraphernalia in the Second Degree. In Court, the District Attorney’s Office recommended that Evans be sentenced to thirty (30) years in prison.
As proven at trial, in January of 2022, Evans sold a quantity of heroin and fentanyl to a known individual in the City of Port Jervis. Less than a week later, Evans again sold a quantity of crack cocaine to the known individual. A judicially authorized search warrant was executed at an apartment in the City of Port Jervis where Evans was located which resulted in the recovery of narcotics, as well as packaging materials for narcotics and the proceeds of the drug sales.
District Attorney Hoovler thanked the City of Port Jervis Police Department and the Orange County Drug Task Force who conducted the investigation that led to the arrest of Evans.
“Drug dealers peddle in death and are responsible for the proliferation of dangerous substances in our communities,” said District Attorney David. M. Hoovler. “Significant sentences, such as the one imposed in this case, are appropriate for violent recidivists whose criminal behavior continues despite previous incarceration. My Office prioritizes the prosecution of drug dealers and will continue to seek long prison sentences for these offenders, where appropriate. Targeted narcotics enforcement actions, investigations and prosecutions have been and will remain a cornerstone priority of my Office.”
District Attorney Hoovler highly commended Assistant District Attorney Alexis Gregory and Senior Assistant District Attorney Jessica Dovico who prosecuted the case.
This criminal charge is merely an allegation that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
